Terms of Service

Welcome to Xiegrain Akasaki! By commissioning my 3D art services, you agree to the following terms and conditions:

1. General Terms

1.1. The client must provide clear references, descriptions, and specifications for the requested 3D model. 1.2. All communications and transactions will be conducted via Discord. 1.3. I reserve the right to decline any commission request for any reason. 1.4. The final product is a digital asset, and no physical item will be delivered.

2. Payment & Pricing

2.1. All prices are quoted in U.S. Dollar and are subject to change based on project complexity. 2.2. A 50% upfront payment is required before work begins. The remaining 50% is due upon completion before the final files are delivered. 2.3. Payments are accepted via PayPal. 2.4. No refunds will be issued once work has commenced.

3. Revisions & Edits

3.1. Clients are entitled to two free minor revisions during the creation process. 3.2. Additional revisions or major changes beyond the agreed scope may incur extra fees. 3.3. No major modifications will be accepted after the final approval and delivery of the project.

4. Delivery & Turnaround Time

4.1. Estimated completion time varies depending on project complexity and will be communicated before the project begins. 4.2. Delays due to unforeseen circumstances (e.g., technical issues, emergencies) will be communicated promptly. 4.3. The final 3D model will be delivered in agreed formats (e.g., .FBX, .OBJ, .BLEND, etc.).

5. Usage & Copyright

5.1. I, Xiegrain Akasaki, retain the copyright of the created work unless otherwise agreed upon. 5.2. Clients may use the commissioned 3D assets for personal or commercial purposes (depending on the agreement). 5.3. Redistribution, reselling, or claiming the work as your own without permission is strictly prohibited. 5.4. If the client wishes to obtain full rights to the 3D asset, an additional buyout fee will be required. 5.5. I reserve the right to showcase the commissioned work in my portfolio unless a Non-Disclosure Agreement (NDA) is requested.

6. Cancellation & Refunds

6.1. If the client cancels the commission before work starts, a full refund will be issued. 6.2. If the client cancels after work has begun, no refund will be provided. 6.3. If I, the artist, am unable to complete the commission for any reason, a full or partial refund will be issued based on the project’s progress.

7. Client Responsibilities

7.1. The client must ensure they have the right to request the commissioned work (e.g., no copyrighted material unless permission is granted). 7.2. The client must provide timely feedback to avoid delays. 7.3. Failure to respond within 7 days may result in project cancellation without a refund.

8. Liability & Disclaimer

8.1. I am not responsible for how the commissioned work is used after delivery. 8.2. I do not guarantee compatibility with all 3D software or game engines unless specified. 8.3. Any disputes should be resolved through direct communication before taking legal action.

9. Agreement

By commissioning my services, you acknowledge that you have read, understood, and agreed to these terms.
